Children's Injuries
Children may be injured at birth as the result of the negligent manner in which a doctor or other medical provider handled their labor and delivery or, following their birth, because of defective products, such as toys, clothes, bedding, or play equipment. Injuries to children can occur at home, on playgrounds, on another person's property, or at their pediatrician's office when a doctor fails to recognize the presence of a serious medical disorder.
While parents typically have two years to bring a claim for any medical expenses they have incurred or any direct injuries they have suffered, children can bring legal claims for up to two years after their eighteenth birthday in Pennsylvania; the laws differ in other states. As a result, injured children, whose conditions may not be fully recognized until years after they happened, can bring claims until they are approximately 20 years, even if the injuries occurred at birth.
