Workplace Injuries and Workers' Compensation

The promise of a safe workplace is largely an unrealized one, with hundreds of thousands, if not millions, of Americans annually suffering serious injuries and death at work because of dangerous machinery, unsafe work surroundings and environments, and careless co-workers. The causes of these injuries are numerous-ranging from slips and falls to missing safety features on tools and equipment to collapsing scaffolding on construction sites.

In some cases, when the cause of the accident is a negligent fellow employee of the same employer, or the employer itself, the worker's only recourse may be workers' compensation benefits, which pay medical expenses, a portion of a worker's lost wages and, if applicable, a death benefit. In many cases, when another party's negligence caused the injury or death, the worker can file a third party/liability claim against the responsible parties.

If, for instance, the accident was caused by the malfunction or improper design of sophisticated piece of machinery, it is important to identify the manufacturer and model number. On the other hand, if an overly waxed floor caused the accident, it is critical to determine who was the responsible party; a fellow employee or a separate maintenance or janitorial service.

At times, employers will cooperate, especially since its insurance carrier is paying workers' compensation. Often, employers are not helpful because they want to protect a relationship with a contractor or for some other reason. Thus, gathering information promptly is an important key to a successful claim.
